The mystery buyer gunning for Kim Kardashian’s sex tape came up short where it matters most … in the wallet … because Vivid Entertainment has officially REJECTED his million offer to take the tape off the market.

Vivid honcho Steve Hirsch tells us, “We were offered million for the Kim tape but have decided that we
are going to hang on to it … for now.”

He adds, “Although the offer that we
ultimately received was substantial, when I realized that it wasn’t Kim
it became less appealing. Kim is a superstar and if it were to be sold, it should be to her.”

TMZ has learned … Charlie Sheen and Brooke Mueller’s custody settlement provides that neither is required to undergo drug testing … something that is becoming increasingly troublesome.

As TMZ first reported … Brooke was photographed last week holding what appeared to be a crack pipe. And there are other problematic images as well — like the one recently in Hawaii, when Brooke walked up to a parked car in a seedy area with cash in hand.

The two rehab veterans each have selfish reasons to avoid drug testing, but Brooke is especially worrisome because she is the primary caregiver of the twins. Although Brooke’s parents step in when she goes to rehab — and she goes a lot — Brooke ultimately calls the shots.

So the question — who is looking out for the kids. The judge hasn’t called a hearing to determine if the parents are unfit, and the L.A. County Department of Children and Family Services has not visited either Charlie or Brooke for more than 6 months.

Charlie Sheen and Brooke Mueller have hashed out a joint custody agreement … lawyers for the former couple told an L.A. judge today.

Sources connected with the case tell TMZ … Brooke’s lawyer, Lori Howe, and Charlie’s attorney, Mark Gross, went into the chambers of Judge Hank Goldberg this afternoon and presented hizzoner with the agreement.  We’re told Howe and Gross told Judge Goldberg the only thing left to be done is getting Brooke and Charlie’s John Hancock.

Sources tell us … the agreement calls for joint legal and physical custody of twins Bob and Max.  We’re told Brooke will get substantially more face time with the kids than Charlie.

The signed agreement will not be filed with the court, in order to keep it completely confidential.  The case has been taken off the court’s calendar.

Dallas Mavericks star Shawn Marion is gonna be busy next month — because we’re told, he’s shooting a pilot for a reality TV show … right around the same time the Mavs crush Miami in the NBA finals (if there is a God).

It’s tentatively called “The Ladies in My Life” — and big surprise … it’s all about Shawn and the important women in his day-to-day … including his mom, sisters, publicist … and his endless stream of lovers.

One of the featured family members is Shawn’s twin sister Shawnett — who’s 6-feet tall and can DUNK a basketball!!

Oh, we almost forgot — the show is being filmed in the NBA star’s 14,000 square foot Dallas mansion.

All it’s missing now … A CHAMPIONSHIP RING, BABY!
